/ OUR PROCESS
You were injured in an accident while visiting Florida. To pursue a lawsuit in a Florida Court, you need a Florida licensed attorney. We can be that attorney. Here’s our process, which incorporates solutions for working together and conducting your case remotely.
1. CONTACT US TO DISCUSS YOUR CASE permalink
We’ll get to work quickly.Three ways to reach us:
a) Visit our Contact Page
b) Email: contact@injuredvisitingflorida.com
c) Phone: 855-523-5628
It’s always better to talk face-to-face. Even though you’re outside Florida, we can schedule a videoconference call.
2. SIGN AGREEMENTS permalink
If we both decide to move forward, we will have you approve and sign agreements electronically, which will make it easy for you.
3. INVESTIGATE THE PARTICULARS OF YOUR ACCIDENT permalink
We’ll look at what, when, where and how your accident happened and who is responsible.
4. IDENTIFY AT-FAULT PARTIES & THEIR INSURANCE COVERAGE permalink
We’ll identify the parties responsible. It’s not just a single person at fault. For example, if you were hit by a ride share driver or a passenger in an ride share vehicle involved in a crash, we can seek recompense from Uber, Lyft, or other ride sharing company. If you suffered a slip and fall at an airport, the airport, as a government entity, has legally dictated limited liability. But the independent janitorial maintenance company that caused the hazard, has no such protections (and, most likely, is well insured). The goal is to determine the best course of action to obtain compensation for your related medical expenses, pain and suffering, disability, lost income, etc.
5. PUT POTENTIAL DEFENDANT ON NOTICE permalink
We’ll reach out to the defendant and let them know about this potential lawsuit. We’ll work with them to find out their insurance company and legal counsel. Don’t reach out to or negotiate with the defendant or representatives directly. It could negatively impact your case. This is why you have us. Let us handle it for you.
6. ENCOURAGE YOU TO FOLLOW THROUGH WITH ALL RECOMMENDED MEDICAL TREATMENTS permalink
Follow the directions of your doctors, including all tests, surgeries, seeing recommended specialists, physical therapy, etc. Do what you are told to do to get better.
7. WORK WITH YOUR DOCTORS, NO MATTER WHERE THEY'RE LOCATED permalink
We’ll obtain all medical records and bills to keep track of your medical expenses from your doctors wherever they are located.
8. NEGOTIATE permalink
Once you’re through with your medical treatment (and we know the extent of your medical expenses), we will engage the defendant through its insurance company or representatives and look to obtain an amount that adequately compensates you.
9. FILE THE LAWSUIT permalink
No settlement yet? We’ll take them to court. Insurance companies often try to stall as long as possible, using a potential court case as a way to intimidate less experienced lawyers. That won’t work with us. We are fully comfortable going to court (see our experience here) and fighting for what you deserve.
10. COORDINATE PROCEEDINGS permalink
By Florida law, there are FOUR proceedings for which you, the plaintiff, must be present for:
a) Deposition - You need to be here in person to tell your side of the story.
b) Mediation - In Florida, before going to trial, the two sides must first meet with a mediator to see if they can work out a settlement.
c) Medical Exam - The insurance company has the right to have you examined by its own in-state doctors.
d) Trial - We realize it’s not convenient to have to return to Florida for these affairs, so we’ll work to schedule your attendance at deposition and mediation by video conference. If you are required to attend in person by the Court, we can file a motion with the court to require the defendant to schedule some of these proceedings during the same trip. The medical exam and trial must be done in person.
11. TRY YOUR CASE IN COURT permalink
If we’re unable to settle and a jury needs to decide the value of your case, we will take your case to trial as we have done for many other clients. Should we go to court, we’ll need to have your doctors testify about your medical care, treatment and injuries as a result of the accident. Since it can be expensive to fly in out-of-state doctors to testify live at trial, we’ll work to coordinate and schedule a remote video deposition for use at trial.
